These Terms of Use (“Terms”) are a legally binding agreement between the user (“User”, “Referral Partner” or “you”) and JF Insurance LLC (“Company”, “we”, “us”, or “our”), governing the access and use of the website hosted at www.homeinsuranceflorida.com (the “Website”).
By registering, accepting, or using the Website, including signing up as a Referral Partner or generating referral links, you acknowledge and agree to be bound by these Terms. Continued use of the Website confirms your ongoing acceptance of the current version of these Terms.
1. USE OF THE WEBSITE
1.1 Eligibility
You must be at least 18 years old (or legal majority in your jurisdiction) to register as a Referral Partner. By using the Website, you warrant full eligibility and, if acting on behalf of a business, that you are authorized to bind that entity.
1.2 Account Registration
To access referral functionality, you must register and maintain accurate, current, and complete account information. Account and link use are restricted to you only; you must not allow any third party to access or use your credentials.
1.3 Referral Link Generation
Registered users may generate a unique referral link solely for lawful sharing with eligible third parties, not for self-referral or use with any false, duplicate, or fictitious identities. Any self-referral, creation of multiple accounts, or misuse of links will result in immediate suspension and forfeiture of earned benefits.
1.4 Permitted Use
You agree to use the Website and referral links only as intended and authorized by the Company, strictly in accordance with these Terms, the Referral Partner Agreement, and applicable laws. You shall not reverse engineer, modify, scrape, distribute, resell, or misuse any Website content or functionality.
2. PROHIBITED CONDUCT
You shall not:
a) Refer yourself, act through false identities, or conduct multiple registrations for personal gain.
b) Share or post referral links publicly on coupon sites, online forums, or other unintended channels unless expressly authorized in writing by the Company.
c) Access another user’s account or allow third parties to use your account or referral link.
d) Upload, transmit, or distribute any viruses, malware, or harmful code.
e) Interfere with, disrupt, or undermine the security, integrity, or function of the Website or its referral system.
f) Use bots, scripts, or other automated tools to access, interact with, or game the Website.
g) Impersonate the Company, its staff, or other users, or misrepresent your affiliation.
h) Attempt to probe, scan, or test the Website or associated networks for vulnerabilities.
i) Engage in any fraudulent manipulation, abuse, or circumvention of the referral, reward, or tracking systems.
j) Collect, store, or use any data from the Website for commercial purposes unrelated to its referral program.
3. REWARDS, TAXES, AND COMPANY DISCRETION
3.1 Program Changes
The Company may modify, suspend, or terminate the referral program, Website, or reward structures at any time for any reason, including systemic fraud or abuse, without liability and with or without notice to you.
3.2 Company Discretion
The Company retains the sole right to determine reward eligibility, suspend or reverse rewards for suspected or confirmed violations, and interpret or amend program rules in its full discretion.
3.3 Tax Responsibility
You are solely responsible for any taxes, levies, reporting, or legal obligations arising from rewards, fees, payments, or incentives earned in the referral program.
4. ACCOUNT TERMINATION
The Company may terminate or suspend your access and account immediately for breach of these Terms, suspected fraud, unauthorized use, or any conduct it deems harmful or disruptive. Termination of access shall not limit the Company's rights or remedies under law or contract.
5. INTELLECTUAL PROPERTY
5.1 Ownership
All content, design, branding, systems, and intellectual property on the Website, including link generation logic and referral infrastructure, remain the exclusive property of the Company and/or its licensors.
5.2 Limited License
The Company grants you a revocable, non-exclusive, non-transferable license solely to access and use the Website and its referral link generation system within the scope of these Terms. Any attempt to reproduce, reverse engineer, sublicense, or commercially exploit the Website or its systems is strictly prohibited and grounds for immediate termination.
6. DISCLAIMER OF WARRANTIES
The Website is provided “as is” and “as available,” without any warranty of any kind, express or implied. The Company disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. No functionality, uptime, or error-free performance is warranted.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company and its affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits or opportunities. Total aggregate liability for any claim shall not exceed the total amount of rewards or fees actually paid to you in the preceding twelve (12) months.
8. INDEMNIFICATION
You agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents against any claim, liability, damage, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Website, violation of these Terms, referral program fraud, unlawful conduct, or infringement of rights.
9. PROGRAM VERSION CONTROL & UPDATES
The Company maintains version-control records for these Terms and will notify registered users of updates via email or Website notice. Your continued use of the Website constitutes irrevocable acceptance of the current version.
10. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Florida, USA, and you irrevocably consent to the exclusive jurisdiction of the courts of Wellington, Florida (or the appellate courts of Florida, as applicable) for any claim or dispute arising under these Terms or through the Website.
11. GENERAL
11.1 Entire Agreement
These Terms, together with any Referral Partner Agreement, constitute the entire agreement between you and the Company concerning Website use.
11.2 Severability
If any provision is deemed unenforceable, the remaining Terms will remain in effect.
11.3 No Waiver
No failure to enforce any provision shall constitute a waiver of that or any other provision.
11.4 Assignment
You may not assign these Terms or any rights or obligations arising hereunder. The Company may assign its rights and obligations at its discretion.
